Special Issue on “Mediation in AEC”
Mediation has been recognized as an economical, faster alternative to either arbitration or litigation and amicable in approach to resolving construction disputes. Its use in construction appears to receive less resistance from the construction practitioners due to its emphasis on confidentiality, opportunity to salvage business relationships, clarity of the third party neutrals’ role, and the flexibility in procedures. Nevertheless, the contractual and statutory rights to employ mediation, the practice of the mediators, maturity of the industry and the legal system, as well as the geographical and cultural differences have also been identified as possible factors influencing its wider use in construction.
While in recent years, research efforts towards understanding the use of mediation in construction have been noted, the related legal issues have yet been fully explored. This special issue seeks to provide a forum to examine the issues arising from the use of mediation in construction such as but not limited to:
- The role of mediation clauses in construction contracts,
- Types of mediation – facilitative versus evaluative,
- Enforceability of voluntary mediation provisions,
- Legal implications and compulsory use of mediation,
- Contextual factors affecting the adoption of mediation,
- Practice and professional development of the mediator,
- Good faith mediation,
- Purpose and philosophy of mediation,
- Behavioral aspects on the use of mediation in construction.
High quality original papers with the above theme of “Mediation in AEC” are invited. Papers referring to legal precedents and presenting arguments from a legal perspective are desired. Each scholarly paper will be sent for a rigorous peer-review assessment by at least two reviewers.
All papers must be submitted in the CHICAGO style of Works Cited, divided between REFERENCES, LIST OF CASES, and ENDNOTES. The use of endnotes for legal papers is specifically encouraged.

Journal of Architectural Engineering
A call for papers has been issued by the Editorial Board of the Journal of Architectural Engineering (JAE) on a number of topics related to architectural engineering research and practice. Depending on the number of responses in each category, the papers will be published as a special issue or grouped into a themed regular issue of the JAE. Topics of interest include; design and construction of building envelopes; research and design of high performance green buildings; comprehensive building security design issues; active and passive fire protection; blast resistant design of buildings (structures and envelopes); residential construction; and architectural engineering education including new trends and case histories.
